The Thane District Consumer Dispute Repair Commission found leading automaker Skoda Auto India Pvt Ltd and its dealer guilty of lack of service and demanded that they pay a man over 6 lakh for complaints about problems in the car he had bought.
Commission chief SZ Pawar and his member Poonam V Maharshi adopted the order earlier this month.
Dhanesh Mothe, a resident of Palghar District, contacted the commission saying he bought the car worth over Rs 8 lakh from JMD Auto Pvt Ltd, a Skoda dealer, in 2014.
While using the car, he encountered several issues such as brake failure, suspension and power window malfunction, he said in the complaint.
Despite being made aware of these issues, the company has not acted on them, he said in the complaint.
He approached the commission to request the replacement of his “defective” vehicle.
In its order, the commission observed that the company had failed to eliminate the defects of the vehicle and to provide a defect-free vehicle in accordance with the warranty.
“Therefore, we hold them guilty of poor service and unfair business practices. However, as the complainant has used the vehicle for more than 60,000 km, its replacement or reimbursement of the full cost cannot be granted.” , he added.
“In our opinion, the complainant is entitled to reimbursement of 75% of the cost of the vehicle, i.e. Rs 6,10,078, with 9% interest from the date of this complaint, as well as Rs 10,000 to cover the cost. of the complaint, ”the commission said.
