The Supreme Court today agreed to hear an application seeking guidelines for the effective implementation of its 2017 judgment and guidelines for regulating the award of the lead counsel designation.

In its October 2017 verdict, the High Court issued a series of guidelines, including the establishment of a standing committee headed by the Chief Justice of India, to grant high-level designation to lawyers.

A bench led by Judge RF Nariman notified the Secretary General of the Supreme Court of an application filed by lead lawyer Indira Jaising who requested the initiation of the process for appointing lead lawyers in accordance with the guidelines.

The request, while referring to virtual court hearings due to the COVID-19 pandemic, said the process of appointing attorneys as lead attorneys will take place in virtual mode.

Ms Jaising said in her petition that pursuant to the Supreme Court’s instructions, the “ Supreme Court Guidelines for Regulating the Assignment of Appointment of Senior Counsel ” was published on August 6, 2018 and set out the process for appointing lead counsel.

“Since August 2018, in accordance with the 2018 guidelines, the Supreme Court registry should have started the designation process in January 2019, July 2019, January 2020 and July 2020,” he said.

“However, no request for this type of invitation to nomination requests has been issued by this tribunal in the last four windows and the process of inviting requests for the nomination of lead counsel stopped after the August 6, 2018, “he said.

The app said that the 2018 guidelines must be executed effectively for the correct implementation of the 2017 verdict.

He said that “the appointment of lead counsel is in the public interest and allows litigants to have a wide variety of talents. Each senior lawyer brings to the table a unique set of expertise, experience and talent thus assisting the court in multiple ways, for example for complex professionals. bono counts ”.

He said the process for appointing a lead lawyer can begin during the lockdown period, as the initial stages of calling for applicants can be conducted electronically.

Depending on demand, in the event that the virtual hearings are extended in the future for a considerable period of time, the entire process of appointing lead counsel can be done virtually electronically.
