Plan B of Congress in Rajasthan if the Court favors the pilot Sachin

Congress has decided on an alternative if Sachin Pilot and his rebel deputies stay the challenge of the Rajasthan High Court. The hearing into the matter will resume on Monday.

Claiming that they did not engage in any anti-party activity, the Sachin pilot camp brought the Congress to justice last week.

Sources in the Congress legal team said the party plans to call a meeting as the next step, if the court favors Mr. Pilot’s team.

During the assembly, the chief minister will prove his figures, which, according to Congress, are greater than the majority. Chief Whip Mahesh Joshi, who is also a respondent in the case, will send a whip to all members of Congress to vote for the party.

If the team pilot violates the whip or abstains, he will be disqualified under article 2 (1) (b) of the tenth calendar for having acted immediately against the whip. However, it can be challenged in court.

The ongoing challenge proceedings against Mr. Pilot and his team fall under Article 2 (1) (a) of the Tenth Annex to the Constitution, also known as anti-defection law.

Notices were sent to Mr. Pilot and 18 MPs with him. With the team camping in an undisclosed location in Haryana, the notices were pasted outside their house, sent as text messages and WhatsApp.

The deputies went to court on Thursday, requesting the annulment of the President’s opinion. Disagreements between elected officials and the party cannot be interpreted as anti-party activity and skipping two meetings is not a reason for disqualification, they argued. They also asked that the anti-defection law, under which the President sought to disqualify them, also be removed.

The disqualification of the rebels will reduce the majority of the 200 assembly members and give chief minister Ashok Gehlot a chance to save his government.

Gehlot, who met with the governor on Saturday to spark speculation of a ground test, says he has the support of 109 MPs.
