Declaration of law by 5 judges is binding on all courts, said P Chidambaram (File)

New Delhi:

A day after the Rajasthan High Court ordered the standstill on disqualification notices for 19 rebel congressmen, the former Union finance minister and party leader P Chidambaram said a 1992 verdict Supreme Court said that judicial review should not cover any stage before a ruling by the President / President.

He said it was up to the people to judge the verdict themselves, as the decision of the five judges of the highest court was binding on all courts.

“For the average citizen who is mystified by High Court and Supreme Court orders, the following passage in plain English should be easy to understand. In 1992, the Supreme Court had ruled: “In view of the constitutional regime of the Tenth Calendar, judicial review should not cover any stage before decision-making by the Presidents / Presidents, and no quia time action is allowed”, Mr. Chidambaram said.

“These words are quite simple and clear. This declaration of the law by 5 judges was binding on all courts, the High Court or the Supreme Court. Now dear average citizen, be the judge,” he said in a series of tweets.

The Rajasthan High Court on Friday ordered that the status quo be maintained on the disqualification notice issued by the President of the State Assembly to 19 dissenting congressmen, including Sachin Pilot.

The Speaker sent the notice to MPs on July 14 after ruling Congress complained that lawmakers challenged a whip to attend two party meetings in the legislature last week.

“The brief request has been granted and the court has ordered the standstill on the notifications dated July 14. The case will be heard in due course now,” a lawyer said for the speaker.
