Delhi High Court ordered the Center to review a man’s complaint who claimed a photograph of his deceased wife was circulating on social media platforms, falsely portraying her as the victim of the Hathras rape case of the UP.
Judge Navin Chawla said if the man’s complaint was correct, the government should act quickly by giving Facebook, Google and Twitter the necessary instructions in this regard.
The court ordered the man to send the necessary documents to support his grievance to the ministry along with a copy of that order and also to identify the URLs that currently contain the offending content.
The court also notified the Department of Electronics and Information Technology, Twitter, Facebook and Google of the plea seeking their responses and set the case up for a new hearing on November 9.
During the hearing, the man told the court that the photo of his deceased wife was being shared on various social media platforms, falsely portraying her as the victim of the unfortunate incident of alleged rape and murder of a young woman. girl in Hathras, Uttar Pradesh.
His lawyer argued that even otherwise, revealing the identity of the rape victim is an offense under the Indian Penal Code, although in this case the image of a bad person is in circulation.
Twitter’s attorney agreed that the man could file a complaint with the National Crime Records Bureau (NCRB), and once the information regarding the offending URLs was passed to him through the appropriate channel referring to this court order, the same would be blocked and removed from its platform.
Google’s board also made similar observations and said that it is only a search engine and that once the information about the URLs of the offending content is passed to it, it will be removed or blocked. .
