Kerala High Court quashes bail for rape accused

On Friday, the Kerala High Court of Justice canceled the bail given to a man accused of raping and killing a schoolgirl and of throwing his body in the city of Tampar Nadu in Valparai in January this year.

“The bail order dated 12 May 2020 is set aside, invoking the powers conferred by article 439 (2) of the Code of Criminal Procedure. The bail request will be dismissed”, a declared a sole magistrate PV Kunhikrishnan in his order.

Earlier, the high court ordered the police to immediately arrest the man identified as Safarshah, who had previously been bailed by the court. Subsequently, the accused was arrested in accordance with the order.

The order followed a petition that the accused was granted bail after defense counsel misled the court, alleging that the charges were not laid before the court. a court within 90 days.

The court said today that there was no serious breach of duty on the part of the prosecutor. “When the error was identified, the prosecutor brought this error to the attention of this court, and the proceedings against him were therefore dropped,” said the bench.

The Attorney General had filed a petition, requesting a recall of the order declaring that the attorney’s argument was an inadvertent error.

The court also accepted an apology from counsel for the accused.
