Jammu and Kashmir suspended DSP Davinder Singh, arrested while transporting two Hezb-ul-Mujahideen terrorists in a vehicle on the Srinagar-Jammu Expressway earlier this year, moved a Delhi court on Tuesday to bail .
Davinder Singh and two other defendants in the case – Irfan Shafi Mir and Sayed Naveed Mushtaq – presented the motions, saying that their police custody was not required in the case.
The court is scheduled to hear the case on Wednesday.
The lawyer MS Khan, appearing for the three defendants who are incarcerated in Tihar prison, told the court that it would be pointless to keep his clients in police custody.
The plea stated that the accused were arrested on March 14, 19 and 27 respectively and are no longer required by the police for the purpose of the investigation.
“The accused are wrongly and wrongly involved in the case. There is no evidence that there is a conspiracy to commit an act with the intention of threatening or likely to threaten the unity, integrity, security or sovereignty of India and there is also no evidence to prove that the accused intended or conspired to conduct a strike of terror, “said their lawyer in the request.
The plea also added that the charges against them are neither substantiated nor substantiated and do not give rise to any prima facie case against the accused.
Dalvinder Singh was suspended from his duties at the Jammu and Kashmir police in January this year. The special cell had brought him to Delhi from Hira Nagar prison in Jammu and Kashmir.
He was arrested in a case related to the planning / execution of terrorist attacks in Delhi and other parts of the country.
According to the police, he used to chat with other co-defendants and activists at the Hizbul Mujahideen via various internet platforms.
Earlier, police told the court that Mushtaq and others were planning to carry out terrorist attacks in Delhi and other parts of the country, as well as targeted killings of protected persons.
Police said Mushtaq, the commander of the Shopian district in Hizbul Mujahiddeen, used to chat with other co-defendants and activists via various Internet platforms, including the black cat.
“Mushtaq, along with other Hizbul Mujahideen activists, planned to carry out terrorist attacks in Delhi and other parts of the country and targeted killings of protected persons,” police said in court.
Delhi police have filed a complaint under section 120B (criminal conspiracy) of the Indian Penal Code (IPC). The FIR said young people in Jammu and Kashmir and Punjab are being trained to carry out terrorist activities.
The case also mentioned Chhota Shakeel, accused in numerous criminal cases.
According to the FIR, the special Delhi police cell had received reports that Company D, led by the damned leader of the Indian hells Dawood Ibrahim, is funding pro-Khalistan terrorist organizations in Punjab.
Davinder Singh was taken into custody in the same case.
The special cell also questioned Dalvinder Singh about the angle of Khalistan, police said.
Although Dalvinder Singh is not named in the case, the Special Unit has certain elements on the basis of which the investigation will be carried out and he will be questioned, police said.
