Former Rajasthani Deputy Chief Minister Sachin Pilot and other lawmakers who rebelled against the government Ashok Gehlot addressed the Supreme Court, asking it to hear them before ruling on any appeals against the order from the High Court earlier today.
The move is seen as likely to be aimed at anticipating Congress, which said on Friday it would move closer to the highest court, hours after the Rajasthan High Court ruled that no action could be taken against Mr Pilot. and other leaders of the rebel party. for the moment.
The order had been seen as a stay for the group against immediate disqualification, although the final verdict was delayed after the high court accepted Team Pilot’s eleventh hour request to add the center to the case in order to be able to determine if the anti-defection law is applicable to them.
On Thursday, the Supreme Court refused to prevent the High Court from delivering the verdict, saying the “voice of dissent” cannot be suppressed in a democracy.
Shortly after the High Court ordered the “status quo”, Chief Minister Ashok Gehlot demanded an assembly “as soon as possible” and protested for more than four hours at the home of Governor Kalraj Mishra, accusing him of sitting on demand because he was “under pressure” to stall a test of strength. The chief minister submitted a list of 102 deputies to the governor, who asked him to send a new session request.
Over the past two weeks, Mr Pilot has staged a mutiny against Chief Minister Ashok Gehlot with the support of 18 other MPs who are being held captive in BJP-led Haryana.
Congress has a small lead over the opposition and has only two more than the 101 majority in Rajasthan’s 200-member assembly. Team Pilot has 19 MPs and the BJP has 72. Including small parties and independent MPs, the opposition currently has 97.
Asked whether Congress would move the Supreme Court against the governor, party leader and lawyer Kapil Sibal said: “Congress will take whatever steps it needs to take in this regard. What the Governor of Rajasthan has done is something that is unprecedented. “
