Ahmedabad:
A non-resident Indian who lives in Canada has filed a habeas corpus petition in the Gujarat High Court, alleging that his wife’s parents would not allow him to return to him.
Judge Sonia Gokani on Wednesday ordered the woman, whose parents live in Mehasana District, Gujarat, to be brought before the High Court on August 5 by videoconference from the nearest district court.
The CH also sent a notice to the police and the woman’s parents.
Petitioner Giriraj Chouhan, from Rajasthan, said he and his wife Ankita Chaudhari met in Canada, where both emigrated for a job and were married in Ontario on January 26, 2018.
When his wife visited her parents in Mehsana, Gujarat in May 2020, they did not allow her to return to Canada and even refused to allow her to meet her, according to the petition.
He feared his life was in danger, he said.
A habeas corpus (“produce the body”) request is filed when a person is suspected of being illegally detained or missing.
“That the corpus (the woman) be presented to the court on the date of return, to be presented before us by video conference to be arranged at the nearest district court in the presence of the president of the court,” said the High Court.
