Maharashtra government said the Maratha community would not be entitled to avail themselves of the 10% employment and education reserve for economically weaker sections (SAPs) in the general state category .
A government resolution (GR), released on July 28, stated that the Maratha community is covered by backward social and educational classes and therefore cannot benefit from the
10 percent reservation under the SAP for state government jobs and admissions to educational institutions in Maharashtra.
The 10 percent quota, a law enacted by the Center, is aimed at economically weaker sections of the open category, who cannot avail themselves of other social reserves, he said.
In the Union government list, the Maratha community is not included among the backward classes and therefore has the right to reserve for recruitment into central government jobs in the SAP category.
But, the EWS reservation will not be applicable to applicants from the Maratha community in state government jobs and admissions to educational institutions in Maharashtra, the order said.
The GR said that there had been complaints that the candidates in the reserved category had obtained EWS certificates.
Tehsildars (tax officials) should check and cross-check to ensure that the candidate who receives an EWS certificate does not fall into any other reserved category, he said.
Relevant officers should also ensure that EWS certificates taken to benefit central government jobs are not used at the state level, the GR said.
The government of Maharashtra had enacted the Socially and Educationally Backward Classes (ESCB) Act 2018, in order to give the Maratha community a reservation in employment and education.
The Bombay High Court, while upholding the law in June last year, ruled that the 16% reserve was not justifiable and said the quota should not exceed 12% for employment and 13 % for admissions.
The Maratha quota law was challenged in the Supreme Court.
