Jammu and Kashmiri woman who was found to be HIV-positive for COVID-19 while in NIA custody, was denied provisional release Tuesday by a Delhi court if she planned an attack terrorist in the country during anti-CAA demonstrations.
Hina Bashir Beg, currently housed at Lok Nayak Jai Prakash Hospital, was arrested with her husband Jahanzaib Sami and another accused Abdul Basith earlier this year.
The judge refused to release her on bail, saying that the allegations against the accused were serious in nature and that she would receive adequate medical treatment.
The judge also asked lawyer MS Khan, who represented the accused, to suggest a private hospital for treatment after claiming that there were no proper treatment facilities in public hospitals.
The defendants were arrested for allegedly promoting the ideology of the Islamic State and provoking protests against the Citizenship Law (CAA), according to the NIA.
The accused’s COVID-19 tests were conducted on June 6, on instructions from the court, while their 10-day interrogation in detention ended on June 7.
“The COVID-19 test report of the defendants, namely Jahanzaib Sami and Mohd Abdullah Basith, is negative but the report of Hina Bashir Beigh is deemed positive,” the NIA said.
Subsequently, the court ordered the NIA to transfer her to the hospital with immediate effect.
“Delhi is struggling to cope with the growing number of positive cases in Corona which have reached 27,000 to date and due to the lack of appropriate treatment facilities in public hospitals, which has also been highlighted in the media, the Delhi government has been forced to publish a list of 56 private hospitals for the treatment of Corona, “said the bail request.
The three accused, believed to have ties to the Islamic State of Khorasan (ISKP) province, were arrested by the Delhi Special Police Unit in March and taken into custody on March 23.
Basith was previously incarcerated in another case which was questioned by the NIA when Delhi police arrested him in this case.
The matter was then transferred to the NIA, which filed a complaint on March 20.
The NIA then went to a special court here to request the interrogation of three defendants, who was authorized for 10 days by the judge on May 20, with instructions to Tihar prison authorities to hand over their custody to seen at NIA “after conducting their COVID-19 test and ensuring that its result is negative”.
The NIA was fired on May 29 after the test result turned negative. Police custody ended today.
The agency said the defendants were actively following ISIS ideology and planning a terrorist strike in India and were also recruiting executives for the ISKP.
