The Allahabad High Court has ordered Uttar Pradesh police not to arrest a government lawyer in a rape case filed by a young lawyer against him.
The court’s Lucknow bench, however, ordered the accused to cooperate with the investigator in the investigation and to make himself available as the appeal proceeds.
A bench of Judges AR Masoodi and Rajeev Singh passed the order on a written motion filed by the defendant, Shailendra Singh Chauhan, challenging the FIR and asking for an instruction to the police not to arrest him during the investigation.
Adopting the interim order, the bench ordered the accused not to threaten the junior lawyer for his life and property.
The 24-year-old junior lawyer filed the case at Vibhuti Khand Police Station in Gomtinagar on July 24, alleging that Shailendra Chauhan raped her in her bedroom that day.
Shailendra Chauhan is the additional senior permanent counsel for the tribunal’s Lucknow bench. He is also the permanent attorney for the Lucknow Municipal Corporation before the High Court.
In his petition, the man asserted his innocence, claiming the rape allegation against him was false and based on ulterior motives.
On hearing the petition, the judiciary said: “Without commenting too much on the merits of the case at this stage, the court accepts the request of the informant’s lawyer, who prays for a week to testify. a response against the petition. “
The bench then granted an order of suspension of the arrest of the petitioner, considering that by simply reading the first information report, a case of intervention in favor of the accused had been established.
Earlier, the additional government lawyer opposed to the petition had pointed out that the rape victim’s statement was registered under article 164 of the Code of Criminal Procedure (CrPC) and that he needed time to obtain his details from the investigator.
